Terms of Service

If you use the Service for a care home or an agency, you agree on its behalf and confirm you are allowed to.

What Havaspot is

Havaspot shows which Arizona care homes have a bed open, and the day each opening was last confirmed. Care homes keep their openings current; agents and placement teams use the board to find them and contact the home.

Havaspot is an information service. We are not a care provider, we do not place residents, and we do not assess whether a home suits anyone. Who may use it

• You must be 18 or over and using Havaspot for work: running or staffing a care home, or placing people in care.
• One person per account. Keep access to your email account secure, because a sign-in link sent there opens your Havaspot account.
• Tell us at [CONTACT EMAIL] if you think someone else has used your account.

Care homes

• You may claim a home only if you are authorized to speak for it. We approve each claim by hand and may ask for proof.
• Keep your openings, prices and other details accurate, and confirm them when they change. A confirmation says the information is true on that day.
• Photos you upload must be of the home, must be yours to share, and must not show residents. See the Acceptable Use Policy.
• Answer agents' messages in good time. Our staff may answer or pass messages on for you, and may confirm openings on your behalf after speaking to you; those show as "Havaspot for the home".
• If you give us contacts for check-in texts, you confirm each contact has agreed to receive them. Anyone can stop texts by replying STOP.

Agents and placement teams

• Use Havaspot to find homes and contact them about real placements.
• Confirm everything that matters directly with the home before you rely on it.
• Do not share your account or copy the board in bulk.

Your content

You keep ownership of what you post: openings, photos and messages. You give us a non-exclusive, worldwide, royalty-free licence to host, show and send it as needed to run the Service, for as long as it is on the Service and for a reasonable period after for backups and records.

Home listings start from public state licensing records. A home's manager can correct its details after claiming it.

Fees

Havaspot is free to use today. There are no paid listings and no paid placement. If we ever introduce fees, we will tell you in advance and you will not be charged unless you agree. [CONFIRM COMMERCIAL TERMS BEFORE LAUNCH.]

Rules

You must follow the Acceptable Use Policy. We may remove content, suspend or close an account that breaks these terms or that puts residents, homes or other users at risk.

Our service

We work to keep Havaspot available and accurate, but we provide it "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and that listings are complete or current.

Liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for decisions about care or placement made using the Service. Our total liability for any claim is limited to [LIABILITY CAP]. Nothing in these terms limits liability that cannot be limited by law.

Indemnity

You agree to cover our reasonable losses from claims caused by content you post or your breach of these terms. [COUNSEL TO REVIEW SCOPE.]

Ending

You can stop using Havaspot at any time and ask us to close your account at [CONTACT EMAIL]. We can suspend or end access as described above, or end the Service with [NOTICE PERIOD] notice.

Data

The Privacy Policy explains how we handle personal information. For business accounts, the Data Processing Agreement also applies.

Law and disputes

Changes
